Richard E. Levine

Richard E. Levine

Richard E. Levine has been litigating business cases for over thirty years. Since the mid-1980's his focus has been on disputes between employers and employees, though he has handled numerous partnership disputes, battles for control of closely held corporations, and professional licensing proceedings. Rick has also tried copyright, real estate, software development and general commercial contract matters.

Rather than limit his practice to only one side in employment matters, Rick regularly represents both employers and employees. The fact that Rick routinely sees both sides of employment disputes, along with his extensive trial experience, gives him an unusual perspective and understanding of the issues. He is able to bring this special perspective to counseling clients in pre-dispute and contract negotiation contexts, and draws upon it when asked to serve as a mediator of employment disputes.

Rick has handled numerous jury trials in both state and federal courts, as well as judge trials and arbitrations before various arbitral forums including JAMS, the American Arbitration Association and the NASD. The greater part of his practice comprises the following substantive areas:
  • Employment discrimination and harassment cases;

  • Wrongful termination cases;

  • Employment compensation disputes including (among others) wage and hour matters,disputes involving equity compensation issues and other employment contract disputes;

  • Unfair competition claims(including trade secret claims) by employers against competing former employees;

  • Battles for control of corporations, LLCs and partnerships.
Rick received his B.A., with honors, from Southern Connecticut State College, and his J.D., with honors, from the University of Pennsylvania Law School, where he was an editor of the Law Review and a legal writing instructor. He is admitted to practice in all California courts and in numerous federal courts outside of California, including the Supreme Court of the United States.

Prior to establishing Levine & Baker LLP with partner Alisa J. Baker, Rick was a partner at the Palo Alto firm of Fenwick & West, and associated with Wayne Skigen in the San Francisco firm of Levine & Skigen.
